To apply for an immigrant visa, the applicant must be sponsored by a relative who could be a U.S. citizen, U.S. lawful permanent resident, or a prospective employer, and the beneficiary of an approved petition. The sponsoring relative must file a petition with U.S. Citizenship and Immigration Services (USCIS).

A U.S. citizen can file an immigrant visa petition for:

  • Spouse
  • Son/Daughter
  • Parent
  • Brother/Sister

A U.S. lawful permanent resident (that is, a green card holder) can file an immigrant visa petition for

  • Spouse
  • Unmarried son or daughter

Following is the step-wise description of filing immigrant visa application:

  • U.S. citizen and lawful permanent residing in the United States file form I-130. Immigration petition must be approved by USICS before beginning the immigrant visa application process.
  • Approved petitions are sent to the department of State’s National Visa Center(NVC) for pre processing. NVC will notify when case becomes current or is likely to become current within a year and will start processing approved petition.
  • When petition becomes current or is likely to become current with one year, the NVC initiates immigrant visa pre processing, including visa fee forms and documents from sponsors and immigrant visa applicants. The availability of immigrant visa numbers depends on the date your petition was filed.
  • Once the case becomes qualified for an interview, NVC works with the appropriate U.S. Embassy or Consulate to schedule an appointment. When appointments date is finalized, an interview letter is sent to applicant as well as petitioner to notify the date, time and location.
  • On scheduled date and time of interview appointment, a consular officer will interview and determine whether to grant the immigrant visa. As a part of the interview process, ink-free, digital fingerprint scan will be taken; consular officer will inform the decision and how and when passport will be returned.
